Terms & Conditions

These Terms & Conditions ("Terms") govern your use of R.U.F.U.S., a sobriety companion application ("Service") provided by Sober Media™ ("Company", "we", "us"). By creating an account or otherwise using the Service, you agree to be bound by these Terms.

1. The Service

R.U.F.U.S. provides a secular, supportive digital companion for individuals pursuing sobriety, including daily check-ins, journaling, structured journeys, and conversational support from an AI character named Rufus. The Service is for general wellbeing and is not medical, psychiatric, or addiction-treatment advice and is not a substitute for professional care.

2. Eligibility & Account

  • You must be of legal age in your jurisdiction to use the Service.
  • You must provide accurate information and keep your account credentials confidential.
  • You are responsible for activity that occurs under your account.

3. Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes, fraud, or spam;
  • Infringe intellectual property or privacy rights of others;
  • Probe, scan, scrape, or interfere with the security or integrity of the Service;
  • Upload malware or attempt to gain unauthorized access to any system;
  • Resell, sublicense, or redistribute the Service without our written consent.

4. Generative AI Features

Rufus is an AI character that generates conversational responses. You are responsible for your prompts, how you use outputs, and for verifying accuracy before relying on any information. Outputs may be inaccurate, incomplete, or unsuitable for medical, legal, financial, or other regulated decisions, and must not be relied on as professional advice. We may filter, refuse, or remove outputs, restrict use, and suspend accounts that misuse AI features, including attempts to generate illegal content, hateful content, sexual content involving minors, malware, deepfakes, or to circumvent safety systems.

5. Intellectual Property

The Service, including its software, content, branding, and the Rufus character, is owned by the Company and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable right to use the Service for your personal sobriety journey under your active plan. You retain ownership of content you submit (journal entries, check-ins) and grant us a limited license to host and process that content solely to provide the Service.

6. Subscriptions, Billing & Payments

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, renewals, cancellations, and refund mechanics are governed by Paddle's Buyer Terms. Subscription pricing and renewal cadence are shown at checkout.

7. No Warranty

The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific requirements. To the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.

8. Limitation of Liability

To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service is capped at the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence where such limitation is prohibited by law.

9. Suspension & Termination

We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends; you may request a reasonable export of your journal data within 30 days, after which we may delete it.

10. Governing Law

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict-of-laws principles. Disputes will be resolved in the courts located in British Columbia, Canada, except where applicable consumer law gives you the right to bring proceedings in your home jurisdiction.

11. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.
